Terms of Service

1. Agreement to These Terms

These Terms of Service ("Terms") are a binding agreement between you and Seeking Optimal ("Seeking Optimal," "we," "us," or "our") governing your use of the seekingoptimal.io website, our daily fantasy sports projections, lineup optimizer, Discord community, and any related services (collectively, the "Service").

By creating an account, purchasing a subscription, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

To use the Service, you must:

  • Be at least 18 years old and have reached the age of majority in your jurisdiction;
  • Be legally permitted to participate in daily fantasy sports contests in your jurisdiction, if you choose to enter contests using lineups built with the Service; and
  • Have the legal capacity to enter into a binding agreement with us.

Daily fantasy sports are not legal in every jurisdiction, and some jurisdictions impose age requirements higher than 18. You are solely responsible for determining whether your participation in any contest is lawful where you live.

3. What the Service Is (and Is Not)

Seeking Optimal provides software tools and information for daily fantasy sports, including player projections, customizable player pools, a lineup optimizer, and lineup exports in CSV format.

We are not a gambling operator. We do not host or operate fantasy contests, accept entry fees or wagers, hold player funds, or pay out winnings. Any contests you enter are run by third-party platforms such as DraftKings, under those platforms' own terms.

Seeking Optimal is not affiliated with, endorsed by, or sponsored by DraftKings, FanDuel, or any other fantasy sports operator or sports league. All third-party names, logos, and trademarks are the property of their respective owners.

4. No Guarantee of Results

Projections, ownership estimates, optimal lineups, and all other outputs of the Service are statistical estimates provided for informational and entertainment purposes only. They are predictions, not promises.

  • We do not guarantee that any projection will be accurate or that any lineup will win, cash, or perform at any level in any contest.
  • You are solely responsible for your contest entry decisions and for any entry fees or losses you incur.
  • Nothing in the Service constitutes financial, investment, or gambling advice.

5. Accounts

You must create an account to access most features of the Service. You agree to:

  • Provide accurate, current, and complete information;
  • Keep your login credentials confidential;
  • Maintain only one account and not share your account with others; and
  • Notify us promptly at support@seekingoptimal.io if you suspect unauthorized use of your account.

You are responsible for all activity that occurs under your account.

6. Subscriptions, Billing, and Cancellation

Certain features of the Service require a paid subscription. Payments are processed by Stripe; we do not store your full payment card details.

  • Automatic renewal. Subscriptions renew automatically at the end of each billing period until you cancel. Your payment method will be charged at the then-current price at the start of each period.
  • Cancellation. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period, and you keep access until then.
  • Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods or unused features.
  • Price changes. We may change subscription prices with reasonable advance notice. Price changes apply at your next renewal; if you do not agree, cancel before the change takes effect.
  • Failed payments. If a renewal payment fails, we may suspend or downgrade your access until payment is completed.

7. Acceptable Use

You agree not to:

  • Scrape, crawl, or use automated tools to access the Service or extract data from it;
  • Resell, redistribute, or publicly republish our projections, data, or other content, in whole or in part;
  • Share, sell, or transfer your account or login credentials;
  • Reverse engineer, decompile, or attempt to extract the source code of the Service;
  • Circumvent or attempt to circumvent any rate limits, access controls, or subscription restrictions;
  • Interfere with or disrupt the Service, its servers, or its networks; or
  • Use the Service for any unlawful purpose.

We may suspend or terminate accounts that violate this section, with or without notice.

8. Intellectual Property

The Service — including our software, projections, data compilations, designs, logos, and other content — is owned by Seeking Optimal or its licensors and is protected by intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service and to download lineup exports for your personal, non-commercial use, including entering contests on third-party fantasy platforms.

If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without restriction or compensation.

9. Third-Party Services

The Service integrates with and links to third-party services, including DraftKings (contest entry), Clerk (authentication), Stripe (payments), and Discord (community). Your use of those services is governed by their own terms and privacy policies, and we are not responsible for their content, availability, or practices.

10. Discord Community

Membership may include access to our Discord server and, for paid subscribers, elevated roles. Access to the Discord community is a courtesy benefit, not a purchased product. We may set community rules, remove content, revoke roles, or remove members at our discretion, including when a subscription lapses. Discord's own terms of service also apply.

11. Changes to the Service

We are continually improving the Service and may add, change, or remove features (including supported sports and data sources) at any time. We may also suspend or discontinue the Service in whole or in part. Where a change materially reduces what you paid for, your remedy is to cancel your subscription.

12. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service.

Sections that by their nature should survive termination — including Sections 4, 8, and 13 through 17 — will survive.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT PROJECTIONS, SALARIES, OR OTHER DATA WILL BE ACCURATE, COMPLETE, OR CURRENT.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEEKING OPTIMAL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST WINNINGS, CONTEST ENTRY FEES, OR OTHER LOSSES ARISING FROM YOUR PARTICIPATION IN FANTASY CONTESTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

15. Indemnification

You agree to indemnify and hold harmless Seeking Optimal and its owners, employees, and agents from any claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your participation in fantasy contests, or your violation of these Terms or applicable law.

16. Dispute Resolution and Class Action Waiver

Informal resolution first. Before filing any claim, you agree to contact us at support@seekingoptimal.io and give us 30 days to attempt to resolve the dispute informally.

Arbitration. If we cannot resolve the dispute informally, any dispute arising out of these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court — except that either party may bring an individual claim in small claims court.

Class action waiver. Disputes must be brought on an individual basis only. You and Seeking Optimal each waive the right to participate in any class, collective, or representative action.

Opt-out. You may opt out of this arbitration agreement by emailing support@seekingoptimal.io within 30 days of first accepting these Terms.

17. Governing Law

The Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement in Section 16. In all other respects, these Terms are governed by the laws of the U.S. state in which you reside (or, if you reside outside the United States, the laws of the State of Delaware), without regard to conflict-of-laws principles.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice on the website or by email before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. The "Last updated" date above reflects the current version.
